أولا : الموافقة على الاتفاتية العامة بين حكومة المملكة العربية السعودية وحكومة

الجمهورية التشيكية الموتع عليها في مدينة الرياض بتاريخ ١٤٢٢/١٢/١٩فـ

الموافق ٢٠٠٢/٣/٣م ، وذلك بالصيغة المراققة .

كل فيما يخصه ـ تنفيذ

ثائيا : على سمو نائب رئيس مجلس الوزراء والوزراء -

ان حكومة المملكة العربية السعودية وحكومة الجمهورية التشيكية "المشار اليهما فيما

بعد بالطرفين المتعاقدين"، رغبة منهما في توثيق اواصر الصداقة القائمة بين البلدين

وتقديرا منهما للفوائد التي يمكن ان تعم البلدين نتيجة لتعزيز التعاون بينهما،

اتفقتا وفقا للانظمة والقوانين المعمول بها في كلا البلدين على ما يأتي:

المادة الاولى

يسعى الطرفان المتعاقدان الى تطوير وتدعيم التعاون بين بلديهما بروح من التفاهم

المشترك،

المادة الثانية

يشجع الطرفان المتعاقدان التعاون الاقتصادي والتجاري والاستثماري والتقني بين

بديهما وبين الاشخاص الاعتباريين والطبيعيين في كلا البلدين ويشمل التعاون

المشار اليه في هذه المجالات بصفة خاصة وعلى سبيل المثال وليس الحصر التالي:

١ - التعاون الاقتصادي بما في ذلك الصناعي والبترولي والبتروكيماويات

والمعدني والزراعي والحيواني والصمي.

تشجيع تبادل المعلومات المتعلقة بالابحاث العلمية والتقنية،

تشجيع تبادل الخبرات الفنية اللازمة لبرامج تعاونية محددة٠

المادة الثالثة

١ - يقوم الطرفان المتعاقدان ببذل افضل مساعيهما لتنشيط وتنويع التجارة المتبادلة

بينهما، ولهذا الغرض وفي حدود النظام الدولي للتجارة ، سوف يطبق الطرفان

المتعاقدان على التجارة المتبادلة بين بلديهما مبدأ معاملة الدولة الاولى بالرعاية

لتجارة منتجات الطرف المتعاقد او المتجهة اليها،

٢ - لا تشمل هذه المعاملة الامتيازات التي يمنحها أي من الطرفين المتعاقدين

لطرف ثالث كنتيجة لانضمامه الى منطقة تجارة حرة او اتحاد جمركي او سوق

مشتركة او اتفاقية مرحلية تؤدي لانشاء اتحاد جمركي أو منطقة تجارة حرة او

المميزات الممنوحة لدول الجوار لتسهيل الحركة الحدودية

المادة الرابعة

يشجع كل من الطرفين المتعاقدين استثمارات الاشخاص الاعتباريين

والطبيعيين للطرف المتعاقد الآخر على اراضيه.

يشجع الطرفان المتعاقدان مشروعات الاستثمار المشتركة بما يتفق والتشريعات

المعمول بها لدى كل طرف من الطرفين المتعاقدين.

٣ - يسعى كل طرف متعاقد لتأمين كافة الضمانات الاساسية للاستثمارات التي

يقوم بها اشخاص اعتباريون او طبيعيون ينتمون للطرف المتعاقد الآخر بما في

ذلك التحويل الحر لكل المدفوعات المتعلقة باستثماراتهم وذلك ضد اجراءات

المصادرة او التأميم المتعلقة باستثماراتهم السارية بما في ذلك ضمان التعويض

العاجل والمناسب والفعال.

يتم وضع الشروط المفصلة للتشجيع والحماية المتبادلة للاستثمارات والتي

تشتمل على كل ما سلف ذكره ضمن اتفاقية خاصة يقوم الطرفان المتعاقدان

بالتفاوض عليها وتوقيعها،

المادة الخامسة

يشجع الطرفان المتعاقدان تبادل الزيارات بين الممثلين والوفود والبعثات الاقتصادية

والتجارية والتقنية بما في ذلك تبادل الزيارات والوفود من القطاع الخاص ، كما

يشجعان المشاركة في المعارض ويقدمان التسهيلات اللازمة لدعم ذلك التعاون س

بلديهما،

المادة السادسة

التعا .

يعمل الطرفان على تشجيع التعاون في المجالات العلمية والثقافية والتعليمية

والرياضية والشبابية ويشمل التعاون المشار اليه في هذه المجالات على سبيل المثـل

وليس الحصر:

١ - التعاون في المجالات العلمية والتقنية وذلك من خلال تبادل المعلومات في

المجالات ذات الاهتمام المشترك والزيارات بين المسؤولين والباحثين والخبراء

والفنيين وتدريب الباحثين والمساعدين والفنيين والمشاركة في الندوات

والمؤتمرات العلمية ذات الاهتمام المشترك ، وكذلك التعاون في وضع الخطط

العلمية وانشاء مراكز ومختبرات البحوث،

٢ - التعاون في المجالات الثقافية والتعليمية والشبابية والرياضية وذلك من خلال

تنسيق المواقف في المحافل الدولية وتبادل البرامج بين المؤسسات والجمعيات

الثقافية والتعليمية والاتحادات الرياضية والشبابية وتبادل الوثائق والمواد السمعية

والبصرية والمكتبية والتجارب ذات العلاقة وكذلك تبادل الزيارات والخبرات بين

المسؤولين عن شؤون الثقافة والتعليم والرياضة والشباب،

يدم تعزيز التعاون في هذه المجالات من خلال تبادل توجيه الدعوات لحضور

الندوات والمؤتمرات والمناسبات الرياضية الوطنية والاقليمية والدولية التي تنظم في

المادة السابعة

يشكل الطرفان المتعاقدان لجنة مشتركة، تعقد اللجنة المشتركة اجتماعاتها بالتناوب

فى كلا البلدين كلما دعت الحاجة لذلك،

المادة الثامنة

١ - تدخل هذه الاتفاقية حيز التنقيذ من تاريخ آخر اخطار يؤكد انهاء أي من

الطرفين المتعاقدين لاجراءات الدولة الداخلية المطلوبة لدخول الاتفاقية حيز

التنفيذ ٠

٢ - مدة الاتفاقية سنة واحدة تبدأ من تاريخ سريان مفعولها وتتجدد تلقائيا لفترات

متتالية مدة كل منها سنة واحدة ما لم يخطر احد الطرفين الطرف الآخر برغبته

في انهاء العمل بها قبل انتهاء مدة السريان بستة اشهر ،

٣ - في حالة انهاء العمل بهذه الاتفاقية يستمر العمل بنصوصها بالنسبة للحقوق

المكتسبة والالتزامات المترتبة على الاتفاقية لفترة يتفق عليها الطرفين

المتعاقدين

حرر في مدينة لرياض في ٢/١٩ ١/ ١٤٢٢ هجري لموافق ٢٣٣/ ٢ ١٢٠٠ ميلادي من

نسختين اصل باللغات العربية والتشيكية والانجليزية تتعادل جميعا من حيث الحجية ،

وفي حالة وجود اختلاف في التفسير بين النص باللغة العربية والنص باللغة التشيكية

يرجع للنص باللغة الانجليزية،
