بعد الاطلاع على المعاملة الواردة من ديوان رئاسة مجلس الوزراء برقم ٥/ب/٣٧٣٢٣ وتـاريخ
١٧ /٩ /٤٢٣ ١ ه، المشمتملة على برقية صساحب السمو الملكي وزير الخارجيسة رقم
(٩٦ /٢/٣٣ ١٣٤ /٠٤٢٨ ١/٤) وتاريخ ٤٢٣/٣/٢٢ ١هـ المرافق لها اتفاقية عامة بـين حكومة
المملكة العربية السعودية وحكومة رومانيا للتعاون في المجالات الاقتصادية والتجارية والاستنمارية
والعلمية والفنية والثقافية والشباب والرياضة .
وبعد الاطلاع على قرار مجلس الوزراء رقم (٦) وتاريخ ١٤٢٣/١/٤هـ.
وبعد الاطلاع على الخضر رقم (٧ ١٥) وتاريخ ٤٢٣/٤/٢٩ ١هـ المعد في هيئة الخبراء .
وبعد النظر في قرار مجلس الشورى رقم (٤/٣٦ ٣) وتاريخ ١٤٢٣/٨/٢٢هـ.
وبعد الاطلاع على توصية اللجنة العامة لمجلس الوزراء رقم (٤٩٨) وتاريخ

اتفاقية عامة
بين حكومة المملكة العربية السعودية
وحكومة رومانيا
للتعاون في المجالات
الاقتصادية والتجارية والاستثمارية والعلمية والفنية
والثقافية والشباب والرياضة
إن حكومة المملكة العربية السعودية وحكومة رومانيا يشار إليهما لاحفا بللطرفين
المتعاقدين" رغبة منهما في تعزيز علاقات الصداقة بين بلديهما وتقديرا للمنافع
المتبادلة من توثيق التعاون بينهما ، اتفقتا وفقا للأنظمة والقوانين المعمول بها في
كلا البلدين على ما يأتي:
المادة الأولى
يسعى الطرفان المنعاقدان لتدعيم التعاون بين دولتيهما بروح من التفاهم المشترك.
المادة الثانية
يعمل الطرفان المتعاقدان على تشجيع التعاون الاقتصادي والتجاري والاستثماري
والعلمي والتقني بين دولتيهما ومواطنيهما بما في ذلك الأشخاص الطبيعيون
والأعتباريون في كلا البلدين ، ويشمل التعاون المشار إليه في هذه المجالات بنوع
خاص وعلى سبيل المثال وليس الحصر الآتي:
١. التعاون في المجال الاقتصادي وبالذات في قطاعات النفط والمعادن
والصناعات البتروكيماوية ، والميادين الزراعية والحيوانية والمشاريع

تشجيع تبادل المعلومات المتعلقة في الأبحاث العلمية والتقنية.
تشجيع تبادل المعرفة والخبرات الفنية المطلوبة لبرامج تعاون محددة،
المادة الثالثة

يشجع الطرفان المتعاقدان توسيع التجارة المتبادلة بينهما وتنويعها ، ووصو
لهذه الغاية وفي إطار النظام التجاري العالمي ، سيطبق الطرفان المتعـاقدان
مبدأ "الدولة الأولى بالرعاية" على التجارة الناشئة بين بلديهما،
لا تؤثر أو تتأثر معاملة "الدولة الأولى بالرعاية" على المزايا الممنوحة من
أي من الطرفين المتعاقدين لاستثمارات مواطنين او شركات تابعين لدولة

أي شكل آخر من أشكال المساعدة أو التعاون الاقتصادي، وكذلك لا يؤثر ،
منح مبدا الدولة الأولى بالرعاية المتعلق بامتيازات يمنحها أي من الطرفين
المتعاقدين لمواطنين أو شركات تابعة لدولة ثالثة بموجب اتفاقية الازدواج
الضريبي او أي اتفاقية أخرى - على قاعدة المعاملة بالمثل فيما يخص
قضايا الضرائب»
المادة الرابعة
١. يعمل الطرفان المتعاقدان طبقا للأنظمة الوطنية في كل منهما ، على تشجيع
وتوسيع الاستثمارات من قبل مواطنيهما وشركاتهما بحرية تامة في كافة
المجالات
٢. يكفل الطرفان المتعاقدان في أراضيهما حماية عادلة وتامة لرؤوس الأموال
والاستثمارات التابعة لهما ولرعاياهما بما في ذلك حرية التحويل لرؤوس
الأموال والأرباح ، ويضمن الطرفان المتعاقدان ان يحصل المستثمر علــى
تعويض عادل وعاجل عما يصيبه من ضرر نتيجة الإخلال بما ورد في هذه
المادة ، بناء على إيرام الطرفان المتعاقدان اتفاقيات مستقلة خاصة بتلك
الحالات المحددة
٣. يشجع الطرفان المتعاقدان قيام المشروعات المشتركة وفقا لأنظمة وتشريعات
الاستثمار المرعية في كلا البلدين.
المادة الخامسة
يعمل الطرفان المتعاقدان على تشجيع تبادل الزيارات بين ممثليهما الاقتصاديين
والتجاريين والتقنيين بما في ذلك القطاع الخاص ، كما يشجعان المشاركة في
المعارض ويوفران التسهيلات اللازمة لها لتعزيز التعاون بين بلديهما.

١، يعمل الطرفان المتعاقدان على تشجيع التعاون في ميادين التعليم والعلوم
والتقنية من خلال تبادل المعلومات في الميادين ذات الاهتمام المشترك ،
وتبادل الزيارات بين المديرين والباحثين والخبراء والتقنيين والباحثين
المتدربين والمساعدين التقنيين ، والمشاركة في الندوات والمؤتمرات العلمية
٢. يعمل الطرفان المتعاقدان على تشجيع التعاون في ميادين الثقافة والشباب
والرياضة بين السلطات المختصة في كلا الدولتين
يتم تشجيع التعاون في هذه المجالات من خلال اتفاقيات مستقلة تتفق عليها

المادة السابعة
يشجع الطرفان المتعاقدان إبرام اتفاقيات مستقلة فى ميادين محددة ذات اهتمام

المادة الثامنة
المعلومات المتبادلة بين الطرفين المتعاقدين يجب الا تستخدم إلا للاغراض
المحددة في اتفاق الطرفين ، ولا يجوز نقلها الى طرف ثالث من دون موافقة
خطية من الطرفين المتعاقدين بهذا الشأن ٠
المادة التاسعة
١. تصبح الاتفاقية سارية المفعول من تاريخ تبادل وثائق التصديق عليها ، وفقا
لنظمة المعمول بها في كلا البلدين ٠
٢. مدة هذه الاتفاقية خمس سنوات ، وتجدد تلقائيا لفترات متتابعة مدتها سنة
ولحدة ما لم ييبلغ أحد طرفيها - قبل ستة اشهر من تاريخ انتهائها - الطوف
الآخر كتابيا بنيته فى انهاءها
٣. في حالة إنهاء هذه الاتفاقية تستمر أحكامها نافذة على البرامج أو المشروعات
أو الاتفاقيات التي تمت في ظلها والتي لم تكتمل قبل انتهاء مدة الاتفاقية أو
إنهائها ، بالإضافة الى الحقوق التي نشات في ظلها قبل انتهاء مدتها أو
إنهائها
وقعت مذه الاتفاقية في مدينة الرياض بتاريخ ٣/٢٢/ ٢٣ ٤ ١ ه الموافق
