رسمنا بما هو آت :
أولا : الموافقة على اتفاقية عامة للتعاون بـين حكومة المملكـة العربية السعودية
ودعومة جمهورية عربا ، المرقمع عليها في مدينة نيويورك يوم الجمعة
١٤٢٥/٨/١٠ مـ، الموافق ٢٠٠٤/٩/٢٤- ، وذلك بالصيغة المرافقة.
ثانيا : على سمو نائب رئيس مجلس الوزا والـوزرا. - معل فيما يغصه
مرسومنا هذا.

اتفاقية عامة للتعاون
حكومة المملكة العربية السعودية
وحكومة جمهورية كوبا
إن حكومة المملكة العربية السعودية وحكومة جمهورية كوبا (المشار إليهما فيما بعد
بالطرفين المتعاقدين)، رغبة في توثيق أواصر الصداقة القائمة بين بلديهما، وتدعيم
الروابط التاريخية بين شعبيهما، وتطوير التعاون بين البلدين ودعمه في المجالات
الاقتصادية والتجارية والاستثمارية والتعليمية والعلمية والفية والثقافية والإعلامية
والسياحية والشبابية والرياضية، وتقديرا منهما للفوائد التي يمكن تحقيقها نتيجة لتعزيز هذا
التعاون وفقا للقوانين والتشريعات المعمول بها في كلا البلدين، فقد انفقتا على ما ياتي:
المادة الأولى
يشجع الطرفان المتعاقدان التعاون الاقتصادي والتجاري والاستثماري بين بلديهما
ومواطنيهما بما في ذلك الأشخاص ذوي الصفة الطبيعية أو الاعتبارية، ويشمل هذا
النعاون دون حصر - ما يأتي:
١. التعاون في جميع المجالات الاقتصادية، وبخاصة في المشروعات الصناعية
والبترولية والمعدنية والبتروكيميائية والزراعية والحيوانية والسياحية والصحية.
٢. تبادل المعرفة والخبرات الفنية اللازمة لبرامج تعاونية محددة.
المادة الثانية
يشمع الطرفان فمتعافدلن التوسع في عتثاتهما التجارية وتتويعها. ولنحقيق مذا الغرض
وفي حدود النظام التجاري الدولي، سيطبقان معاملة الدولة الأولى بالرعاية على التجارة
المنبادلة بين البلدين. ولا تشمل معاملة الدولة الأولى بالرعاية الامتيازات التي يمنحها أي
من الطرفين المتعاقدين لمواطني أو شركات دولة ثالثة نتيجة لمشاركتها في منطقة تجارة
حرة، أو اتحاد جمركي، أو سوق مشتركة، أو أفضليات ممنوحة للدول الأقل نموا، أو أي
شكل آخر من أشكال التعاون الاقتصادي الإقليمي.
المادة الثالثة
يشجع الطرفان المتعاقدان استثمارات مواطنيهما وتسهيلها في جميع المجالات، ماعدا
المجالات المستثناة طبقا لتشريعاتهما الداخلية.

٢. يضمن الطرفان المتعاقدان حرية التحويل بين البلدين وعدم اتخاذ أي إجراء من شأنه
حرمان المستثمر من ملكية رأس ماله أو أرباحه كليا أو جزئيا، بما في ذلك حرية
تحويلها. كما يضمنان حصول المستثمر على تعويض عادل وعاجل عما يصيبه من
ضرر نتيجة الإخلال بذلك.
يشجع الطرفان المتعاقدان قيام مشروعات مشتركة طبقا لقوانين وتشريعات الاستثمار
المرعية في كلا البلدين.
المادة الرابعة
يشجع الطرفان المتعاقدان تبادل الزيارات بين ممثليهما ووفود هما الاقتصادية
والتجارية والتقنية بما في ذلك من القطاعين العام والخاص.
يشجع الطرفان المتعاقدان المشاركة في المعارض التجارية التي تقام في كلا اللدان،
وتقديم التسهيلات اللازمة لذلك.
المادة الخامسة
يعمل الطرفان المتعاقدان على ما يأتي:
تشجيع التعاون التعليمي والبحث العلمي والعلمي والتقني من خلال تبادل المعلومات فى
المجالات ذات الاهتمام المشترك، وتبادل المعلومات المتعلقة بالبحوث العلمية والتقنية،
وتبادل الزيارات بين المسؤولين والباحثين والخبراء والفنيين، ومن خلال تدريب
الباحثين والمساعدين الفنيين، والمشاركة فى الندوات والمؤتمرات العلمية ذات الاهتمام
المشترك.
تشجيع التعاون الثقافي والشبابي والرياضي من خلال تنسيق مواقفهما في المحافل
الدولية، وتبادل البرامج بين الجمعيات والاتحادات الشبابية والرياضية، وكذلك تبادل
الزيارات والخبرات بين المسؤولين عن شؤون الشباب والرياضة.

تبادل الزيارات والخبرات بين المؤسسات الإعلامية العامة والخاصة في المجالات

تشجيع السياحة بين البلدين وتنميتها من خلال تبادل المعلومات السياحية وتشجيع

المادة السادسة
يشجع الطرفان المتعاقدان إبرام اتفاقيات مستقلة في ميادين محددة ذات اهتمام مشترك،
متى دعت الحاجة إلى ذلك.
المادة السابعة
١. تدخل هذه الاتفاقية حيز التنفيذ من تاريخ أخر إشعار متبادل عبر القنوات الدبلوماسية
يؤكد إنهاء كلا الطرفين المتعاقدين الإجراءات الداخلية اللازمة لدخولها حيز التنفيذ.
٢. مدة هذه الانفاقية خمس سنوات تبدأ من تاريخ نفاذها، وتتجدد تلقائيا لفترة أو فترات
متتالية مدة كل منها سنة وأحدة ما لم يقدم أحد الطرفين المتعاقدين إشعارا مكتوبا
برغبته في إنهاء العمل بهذه الاتفاقية قبل انتهاء مدة نفاذها بستة أشهر على الأقل.
٣. في حالة إنهاء العمل بهذه الاتفاقية، تستمر أحكامها نافذة المفعول بالنسبة إلى البرامج أو
المشروعات أو الاتفاقيات التي ثمت في ظلها، والتعاقدات أو الالتزامات التي لم يتم
الانتهاء من إنجازها أو الحقوق التي لم تتم تسويتها، وكذلك بالنسبة إلى تصفية المراكز
المستحقات المالية الجارية قبل إنهاء العمل بهذه الاتفاقية، سواء أتعلقت جميعها
بالحكومات أم بالأشخاص ذوي الصفة الطبيعية أو الاعتبارية.
حررت هذه الاتفاقية في نيويورك يوم الجمعة ١٠/ ٨/ ٤٢٥ ١ هجري الموافق ٩/٢٤/
٢٠٠٤ ميلادي من نسختين أصليتين باللغات العربية والأسبانية والإنجليزية، وجميع
النصوص متساوية في الحجية. وفي حالة الاختلاف في التفسير تكون المرجعية للنص
المكتوب باللغة الإنجليزية.
