إن الأطراف الداخلة في مذكرة التفاهم،
إذ تسترشد بقرار المجلس الاقتصادي والاجتماعي ١٨١٨ (د-٥٥) المؤرخ ٩ أب/أغسطس ١٩٧٣،
الذي أنشئت بموجبه اللجنة الاقتصادية لغربي آسيا وحددت اختصاصاتها، والمعدل بالقرار ٦٩/١٩٨٥
المؤرخ ٢٦ تموز/يوليو ١٩٨٥، الذي عدل بموجبه اسم اللجنة واختصاصاتها لتشمل البعد الاجتماعي،
وبأهداف التعاون المبينة في القرارين،
وسعيا منها إلى توطيد علاقات التعاون والتكامل بين دول المشرق العربي الأعضاء في الإسكوا،
وإذ تدرك أن النقل البحري يؤدي دورا هاما في تعزيز التجارة البينية والخارجية ودعم التكامل
الاقتصادي والاجتماعى في منطقة الاسكوا والمنطقة العربية عموما،
وإيمانا منها بالحاجة إلى ضمان تطور مطرد للأساطيل البحرية الوطنية في المنطقة وتنمية متوازنة
للنقل البحري والموانئ البحرية،
وإذ تأخذ في الاعتبار ما ينسجم ولا يتناقض مع الاتفاقات والقرارات والترتيبات التي سبق واتفقت
عليها الأطراف الداخلة في المذكرة في إطار جامعة الدول العربية بشأن التنسيق والتعاون والتكامل بين الدول
العربية في قطاع النقن،
وإذ تؤكد على عدم تعارض مذكرة التفاهم مع الاتفاقات والمعاهدات الاقليمية والدولية التي انضمت
إليها الأطراف في المدكرة،
وتصميما منها على تعزيز التعاو ومواءمة وتنسيق السياسات في المجالات ذات الأولوية في قطاع
النقل البحري والموانئ، وذلك ضمن
العلاقات المشتركة بين الأطراف في المذكرة ومع الدول الأخرى،
مما،
وسلا بتوصية لجنة النقل في دورتها الثالثة، لتي فقدت في بيروت في لنترة من و بى
اذار/مارس ٢٠٠٢، بشأن ضرورة إيلاء النقل البحري المزيد من الدعم ليواكب ما أنجز في مجال النقل
البري، وإعداد الدراسات والمشاريع في هذا المجال، ومن ضمنها مشروع اتفاق للنقل البحري بين الأطراف
في المذكرة، وتيسير الوسائل والسبل المناسبة لتحقيق هذه الغاية،
وانسجاما مع القرار ٣٠٩ المؤرخ ٢٣ آذار/مارس ٢٠٠٥، الصادر عن مجلس جامعة الدول العربية
المنعقد على مستوى القمة في دورته السابعة عشرة في الجزائر، بشأن أهمية وضع إطار قانوني للتعاون
العربي في مختلف مجالات النقل البحري، بما يحقق أساسا صلبا لاستغلال إمكانات القطاع الملاحي العربي
الخاص على النحو التكاملي الأمثل،

اتفقت على ما يلي:
الصادة ١
تعاريف
تعرف المصطلحات الواردة ضمن مذكرة التفاهم على النحو التالي:
الأساطيل الوطنية للملاحة البحرية
يقصد بها السفن التابعة لشركات القطاع العام أو القطاع الخاص الوطنية منها والمشتركة مع دول، أو
شركات أو أفراد تابعين لدول أخرى، وترفع علم إحدى الأطراف في المذكرة.
الموانئ والمرافئ البحرية
يقصد بها جميع الموانئ والمرافئ التجارية البحرية في المنطقة بغض النظر عن طاقاتها وسعتها
والأغراض التجارية التي تختص بها.
النقل الساحلي
يقصد به النقل البحري ما بين موانئ ومرافئ المنطقة، مع مراعاة نظم وتشريعات كل من الأطراف
فيما يتعلق بالملاحة الساحلية.
النقل الدولي المتعدد الوسائط
يقصد به ما هو معرف في اتفاقية الأمم المتحدة للنقل الدولي المتعدد الوسائط للبضائع على أنه نقل
بضائع بواسطتين مختطفتين على الأقل من وسائط النقل، على أساس عقد نقل متعدد الوسائط، من مكان في بلد
ما ياخذ متعهد النقل المتعدد الوسائط فيه النضائع في عهدته إلى المكان المحدد للتسليم في بلد آخر 8."

رقابة الدولة عنى السفن في الموانن البحرية
يقصد بها آلية التفتيش والرقابة على السفن الأجنبية التي تزور موانئ المنطقة والمتعارف عليها دوليا
بالرقابة من قبل دولة الميناء "Control-PSC State Port".
نادي الحماية والتعويض البحري (CIub lndemnity and Protection)
يقصد به النادي الذي يتولى تغطية الأخطار التي تتعرض لها البضائع وملحقات السفن وأطقمها،
والخسائر التي يتكبدها الطرف الثالث والتي لا تغطيها شركات التأمين.

تصنيف السفن
يقصد به الإشراف على المستوى الفني ومستوى الجودة من خلال اتباع المبادئ والقواعد العالمية في
بناء وتعديل تصاميم السفن، وصيانتها وإصدار الشهادات والتقارير الخاصة بذلك.
المادة ٢
مبادئ وأهداف مذكرة التفاهم
تراعي الأطراف الداخلة في مذكرة التفاهم المبادئ الأساسية التالية للتعاون في مجال النقل البحري:
(أ) العمل على مواءمة سياسات الأطراف في المذكرة وتنسيقها في المجالات المتصلة بالنقل
البحري الإقليمي والدولي والمو انئ والمرافئ البحرية؛
(ب) حل انشطة وخدمات النقل البحري والموانئ والمرافئ البحرية اكثر كفاءة وفاعلية، سعيا إلى
تعزيز التنمية الاقتصادية والاجتماعية (ترفق بهذه المذكرة خريطة لشبكة الموانئ والمرافئ البحرية
والمسارات الملاحية في المشرق العربي على سبيل الاسترشاد فقط ولا تشكل جزءا من هذه المدكرة).
تراعي الأطراف الداخلة في مذكرة التفاهم الأهداف التالية للتعاون في مجال النقل البحري:
تحديد وتنفيذ سياسات ملاحية متوائمة وقادرة على تحقيق تنمية مستدامة للأساطيل البحرية
التجارية، وتوطيد التعاون بين الأطراف في المذكرة على الصعيدين الإقليمي ودون الإقليمي ومع سائر
الأقاليم والمناطق؛
(ب) عقد مشاورات منتظمة تستهدف التوصل إلى مواقف موحدة على الصعيدين الإقليمي والدولي
بشأن سناسات النقل البحري، واتخاذ قرارات، واعتماد حلول لمسائل وعقبات محددة في مجال سياسات النقل

رج مواءمة تطلعات وموافف الأطراف في المذكرة فيما يتعلق بالانضمام إلى الاتفاقات والمعاهدات
الإقليمية والدولية في مجال النقل البحري التي هي أطراف فيها وتنفيذ تلك الاتفاقات والمعاهدات؛
(د) تعزيز التعاون الثنائي والمتعدد الأطراف بين إدارات النقل البحري أو الإدارات البحرية؛
(م) إعداد الدراسات التي تشجع تعزيز التعاون بين الأطراف في مجال النقل البحري وعمليات
المو انئ والمرافئ البحرية ومع سائر المناطق؛
أنشطة مجالس
(و) العمل على تعزيز دور المؤسسات الوطنية للنقل البحري وتفعيلها، وتشجيع
واتحادات الشاحنين، والوكالات الممثلة لها، وخطوط الملاحة الوطنية، وجمعيات واتحادات وهيئات الملاحة
العلمي في المجال البحري،

المادة ٣
الأساطيل الوطنية للملاحة البحرية
اتفقت الأطراف الداخلة في مذكرة التفاهم على ما يلي:
(أ) إجراء الدراسات وتبادلها، والمتابعة الدورية لوضع شركات الملاحة الوطنية سعيا إلى
تطويرها؛
(ب) تحفيز مؤسسات التمويل في المنطقة وخارجها لدعم الأطراف الداخلة في المذكرة في سياساتها
لتحسين الأساطيل الوطنية وتشغيلها وتطويرها، والدعوة إلى إنشاء صندوق متخصص لتمويل شراء وبناء
السفن الحديثة بهدف تطوير الأساطيل الوطنية؛
كات الملاحة الوطنية التابعة للأطراف الداخلة في المذكرة في اتفاقات
(ج) تشجيع دخول شر
مشتركة وتحالفات وعمليات دمج فيما بينها، وتشجيع حرية تقديم خدمات نقل شاملة وفعالة، ومن ضمنها
خدمات النقل الدولي المتعدد الوسائط؛
(د) تشجيع العمل على نقل البضائع على الأساطيل الوطنية كلما كان ذلك ممكنا، على أن يشمل
ذلك العمليات التجارية المنبثقة من المساعدات الحكومية والاتفاقات التجارية الثنائية والمتعددة الأطراف، مع
التشديد على كفاءة الخدمات وقدرتها التنافسية؛
(م) التنسيق والتكامل بين الأساطيل الوطنية للأطراف الداخلة في المذكرة في مجال نقل البضائع
وتبادل الفراغات والمشاركة في الخدمات لتحقيق الاستخدام الأفضل للأساطيل، وتشجيع .
اقامة شبكات تسويق
مشتركة لخدمات النقل البحري على الصعيدين الإقليمى والدولي، وذلك عن طريق تفعيل دور الاتحادات
المتخصصة القائمة مثل الاتحاد العربي للناقلين البحريين والاتحادات التي ستنشأ في المستقبل؛
(و) توحيد وتنسيق الجهود فى متابعة أحدث التطورات في قطاع النقل البحرى وتطبيق الشروط
والمعابير البحرية الدولية؛

الموانئ والمرافئ البحرية
اتفقت الأطراف الداخلة في المذكرة على:
(أ) تبسيط ومواءمة القوانين واللوائح والإجراءات التي ترعى عمليات الموانئ والمرافئ البحرية،
ومن ضمنها الإجراءات الجمركية والصحية والإدارية، وذلك لتقصير مدة بقاء السفن في موانئها تماشيا مع
اتفاقية تسهيل حركة الملاحة البحرية الدولية وتعديلاتها؛
(ب) تطوير وتحديث الهياكل المؤسسية لإدارة الموانئ والمرافئ البحرية تحقيقا لزيادة الكفاءة؛

(ج) مواءمة هياكل التعريفات والرسوم والأجور والنظم الإحصائية للنقل البحري والموانئ؛
(د) توطيد التعاون بين الأطراف في المذكرة في مجال تبادل الخبرات في إدارة الموانئ والمرافئ
البحرية وعملياتها؛
() رفع مستويات الأداء والكفاءة في الموانئ والمرافئ البحرية وزيادة قدراتها التنافسية؛
(و) تنويع أنشطة الموانئ والمرافئ البحرية، بحيث تشمل على سبيل المثال لا الحصر، المجالات
الصناعية والتجارية واللوجستية وخدمات التوزيع الإقليمي والدولي؛
(ز) تبادل المعلومات باستخدام نظم التبادل الإلكتروني للبيانات حول خطوط الملاحة والسفن العاملة
نين الموانئ والمرافئ، والطاقات المتاحة للأساطيل الوطنية، تحقيقا للتنسيق والتكامل؛
إعداد الدراسات الدورية والخطط الاستراتيجية لتنمية وتطوير الموانئ والمرافئ.

المادة ه
النقل الساحلي بين موانئ الأطراف الداخلة في المذكرة
اتفقت الأطراف الداخلة في المذكرة على تطوير النقل الساحلي بين موانئها بهدف زيادة حجم التبادل
التجاري البيني، وذلك عبر الطرق التالية:
(أ) تشجيع حركة النقل الساحلي بين الموانئ والمرافئ، وتقديم التسهيلات والدعم لشركات النقل
الساحلي الوطنية؛

المادة ٦
رقابة الدولة على السفن في الموانئ البحرية
اتفقت الأطراف الداخلة في المذكرة على:
(أ) العمل على تطبيق نظام رقابة الدولة على السفن في موانئها البحرية، مع التعاون في مجال
التبادل الإلكتروني للبيانات المتعلقة بشهادات ومستندات تلك السفن؛

(ب) إنشاء مراكز مراقبة في الموانئ مع توحيد الإجراءات المتبعة فيها وتزويدها بمراقبين ومفتشين
متخصصين وذوي خبرة، بما يتفق مع قواعد الاتفاقيات الدولية النافذة في هذا المجال.
المادة ٧
العمالة البحرية والتعليم والتدريب
تراعي الأطراف الداخلة في المذكرة ما يني:
(أ) الالتزام بالقوانين والمعايير الإقليمية والدولية الخاصة بالعمالة البحرية وظروف المعيشة
والعمل على ظهر السفن، والتعليم والتدريب والتأهيل البحري؛
(ب) الانضمام إلى الاتفاقات والمعاهدات الإقليمية والدولية ذات الصلة بالعمالة البحرية والتعليم
والتدريب والتأهيل، وخاصة تلك الصادرة عن منظمة العمل الدولية والمنظمة البحرية الدولية؛
(ج الامتعانة بالعمالة البحرية من مواطنيها طى الأساطيل الوطنية، شرط استيفاء المو هلات
المطلوبة وفقا للمعاهدات الدولية النافذة، وإعطاء الأولوية للعمالة الوطنية بتطبيق نظام لتبادل العمالة البحرية؛
(د) توهير فرص التدريب العملي البحري على سفن الأطراف في المذكرة، وذلك للطلبة المتدربين
والضباط والمهندسين البحريين من مواطني الأطراف الداخلة في المذكرة، وخاصة تلك التي لا تمتلك سفنا
لتأدية الخدمة البحرية عليها؛
(م) انشاء ودعم مراكز ومؤسسات التعليم والبحوث والتدريب والمعلومات في قطاع النقل البهري
وذلك تحقيقا لما يلي؛
(١) إنشاء بنك معلومات بحري لتخزين المعلومات وتبادلها بين الأطراف
في المذكرة بو اسطة نظم التبادل الالكترونى للبيانات؛

المادة ٨
السلامة والأمن البحري وحماية البيئة البحرية
اتفقت الأطراف الداخلة في المذكرة على:
(أ) الالتزام بالقوانين والمعايير الإقليمية والدولية الخاصة بالسلامة البهرية؛
(ب) الالتزام بالقوانين والمعايير الإقليمية والدولية الخاصة بأمن الموانئ والسفن؛

(ج) التنسيق والتعاون في مجال مكافحة التلوث البحري؛
(ط) إنشاء ودعم مراكز التعليم والتدريب في مجال السلامة والأمن البحريين والبيئة.

المؤتمرات الإقليمية والدولية
اتفقت الأطراف الداخلة في المذكرة على:
(أ) التنسيق بهدف التوصل إلى مواقف موحدة على الصعيدين الإقليمي والدولي؛
(ب) المشاركة الفاعلة في المؤتمرات الدولية المعنية بالنقل البحري والموانئ، وذلك للمساهمة في
وضع السياسات والتشريعات الإقليمية والدولية للنقل البحري والموانئ، حرصا على حقوق ومستقبل قطاع

المادة ١٢
تصنيف السفن
اتفقت الأطراف الداخلة في المذكرة على العمل لتفعيل الهيئة العربية لتصنيف السفن ودعوة الدول
غير المنضمة إلى اتفاقية إنشاء الهيئة للانضمام إليها.
المادة ١٣
النقل الدولى المتعدد الوسائط
اتفقت الأطراف الداخلة في المذكرة على الدعوة إلى تطبيق النقل الدولي المتعدد الوسائط في إطار
نظام النقل المتكامل في المشرق العربي ووفقا للإجراءات والصكوك المعترف بها دوليا بشأن عمليات هذا
النمط، والانضمام إلى اتفاقية الأمم المتحدة للنقن الدولي المتعدد الوسائط للبضائع والاتفاقيات الأخرى ذات
الصلة.
المادة ١٤
التشريعات والإجراءات
اتفقت الأطراف الداخلة في المذكرة على تطوير التشريعات البحرية السارية، بحيث تحقق أهداف
تطوير النقل البحري والموانئ وتتماشى مع الاتفاقات والمعاهدات الدولية المعنية.
المادة ١٥
آليات التنفيذ
اتفقت الأطراف الداخلة في المذكرة على أن تتولى لجنة النقل في الاسكوا متابعة تنفيذ مذكرة التفاهم
وتفعيلها.

التوقيع والتصديق والقبول والموافقة والانضمام

يفتح باب التوقيع على مذكرة التفاهم في دمشق خلال الفترة من ٩ إلى ١٢ أيار/سايو ٢٠٠٥ لأعضاء
٣١ انون
اللجنة الاقتصادية والاجتماعية لغربي آسيا، ثم في مقر الأمم المتحدة في نيويورك حتى
الأول/ديسمبر ه..٢.
الأعضاء المشار إليهم في الفقرة ١ من هذه المادة أطرافا داخلة في مذكرة التفاهم بإحدى

٣ - يصبح التصديق أو القبول أو الموافقة أو الانضمام ساري المفعول بعد إيداع الصك المطلوب لدى
جهة الإيداع.
٤ - يمكن للدول غير الأعصاء في الإسكوا أن تصبح أطرافا داخلة في مذكرة التفاهم عن طريق إبداع
صك الانضمام لدى جهة الإيداع إذا حصلت على موافقة جميع الأطراف الداخلة في مذكرة التفاهم الأعضاء
في الإسكوا. وتوزع الأمانة التنفيذية للإسكوا طلنات انضمام البلدان غير الأعضاء في الإسكوا على أعضاء

المادة ١٧
الدخول حيز التنفيذ
تدخل مذكرة التفاهم حيز التنعيد بعد (٩٠) تسعين يوما من تاريخ قيام (٥) خمسة أعضاء في الإسكوا
إما بالتوقيع النهائي عليها، أو بإيداع صك التصديق أو القبول أو الموافقة أو الانضمام.
٢- بالنسبة إلى كل عضو في الإسكوا، بقوم بالتوقيع النهائي على مذكرة التفاهم أو بإيداع صك التصديق
أو القبول أو الموافقة أو الانضمام بعد التاريخ الذي قام فيه (٥) خمسة أعضاء في الإسكوا بالتوقيع النهائي
التنفيذ بعد مرور (
عليها أو إيداع صك التصديق أو القبول أو الموافقة أو الانضمام، تدخل مذكرة التفاهم حيز
٩٠) تسعين يوما على تاريخ قيامه بالتوقيع النهائي أو تاريخ إيداع صك التصديق أو القبول أو الموافقة أو
الانضمام. وبالنسبة إلى كل دولة غير عضو في الإسكوا تقوم بإيداخ صك الانضمام، تدخل مذكرة التفاهم
حيز التنفيذ بعد مرور (٩٠) تسعين يوما على تاريخ ايداعها ذلك الصك.
المادة ١٨
التعديلات
د
بعد دخول مذكرة لتقاهم حبز التتفيذ، يعوز لأي طرف داغل فيها أن يقترح تعديتت طيها.

تقر التعديلات إذا حصلت على موافقة ثلثي الأطراف الداخلة في مذكرة التفاهم الحاضرة في اجتماع
يعقد لهذا الغرض، متضمنة الأطراف المعنية مباشرة بالتعديل المقتر ح.
تتولى لجنة النقل في الإسكوا إبلاغ جهة الإيداع بالتعديلات المقرة وفقا للفقرة ٣ من هذه المادة خلال
٤
مدة لا تتجاوز (٤٥) خمسة وأربعين يوما، تلي تاريخ إقرار تلك التعديلات.
تبلغ جهة الإيداع التعديلات المقرة إلى كل الأطراف الداخلة في مذكرة التفاهم، وتصبح هذه
التعديلات سارية المفعول على كل الأطراف بعد (٣) ثلاثة أشهر من إبلاغها، إلا إذا استلمت جهة الإيداع
اعتراضات من أكثر من ثلث الأطراف الداخلة في مذكرة التفاهم خلال (٣) ثلاثة أشهر تلي تاريخ الإبلاغ

لا يجوز إجراء أي تعديلات على مذكرة التفاهم خلال الفترة المحددة في المادة ١٩، إذا أصبح عدد
الأطراف الداخلة في مذكرة التفاهم أقل من (٥) خمسة، عقب انسحاب أحد الأطراف.
المادة ١٩
الانسحاب
يجوز لأي من الأطراف الداخلة في مذكرة التفاهم الانسحاب منها بموجب إشعار مكتوب يوجه إلى
جهة الإيداع. ويسري هذا الانسحاب بعد (١٢) اثني عشر شهرا من تاريخ إيداع الإشعار، ما لم يعدل
الطرف الداخل في مذكرة التفاهم عنه قبل انقضاء تلك الفترة.
المادة ٢٠
الانتهاء
ينتهي سريان مفعول مذكرة التفاهم إذا أصبح عدد الأطراف الداخلة فيها أقل من (٥) خمسة خلال أية
فترة مدتها (١٢) اثنا عشر شهرا متتالية.
المادة ٢١
حدود تطبيق المذكرة
لا يمنع أي نص وارد في مذكرة التفاهم أي طرف داخل في مذكرة التفاهم من اتخاذ أي إجراء
يعتبره ضروريا لأمنه الداخلي أو الخارجي ولمصالحه.
٢- يتطلب ذلك الإجراء، الذي يفترض أن يكون مؤقتا، الإبلاغ عنه لدى جهة الإيداع فور اتخاذه، وكذلك
اطلاعها على طبيعة ذلك الإجراء.
لا تمنع مذكرة التفاهم الأطراف الداخلة فيها من عقد اتفاقات أو معاهدات مشتركة في مجال النقل
لبحري والمواني والمر افى مع استرشاد باسس مذرة التفاهم وأهدافها ما أمكن ذلك.
