ويعد الاطلاع على قرار مجلس الوزراء رقم ( ١٨٦ ) بتاريخ ١٤٣٣/٦/٩ف.

وسمنا بما هو آت:

الاديان والفتانات، الموقع مليها في العاصمة النمساوية فيينا بتاريخ ٢٠١١/١٠/١٣،

بعد الاطلاع على المعاملة الواردة من الديوان الملكي برقم ٢٠٤٦٩ وتاريخ

٤/١٤/ ١٤٣٣ه، المشتملة على برقية صاحب السمو الملكي وزير الخارجية رقم

٣٤١٤٨٩/٢٠/٩٢ وتاريخ ١٤٣٢/١١/٢٠هـ، في شأن مشروع اتفاقية تأسيس مركز الملك

عبدالله بن عبد العزيز العالمي للحوار بين أتباع الأديان والثقافات

وبعد الاطلاع على مشروع الاتفاقية المشار إليه.

وبعد الاطلاع على قرار مجلس الوزراء رقم (٢٩٤) وتاريخ ١٤٣٢/١٠/١٤ف.

وبعد الاطلاع على المحضر رقم (٣٨٥) وتاريخ ٨/٢٩/ ٤٣٢ ١ ه، والمجضر رقم (٣)

وتاريخ ١٤٣٣/١/١٨ه، المعدين في هيئة الخبراء بمجلس الوزراء.

وبعد النظر في قرار مجلس الشورى رقم (٨/١٠) وتاريخ ٤٣٣/٣/٢٨ اه.

العالمي للحوار بين أتباع الأديان والثقافات

إن الأطر اف الموقعة على هذه الاتفاقية؛

اقتناعا منها بأهمية الحوار بين أتباع الأديان والثقافات بوصنه وسيلة لمعالجة البعدين الديني والروحي

للإنسان والمساعدة على القيام بعدد من الأعمال من بينها منع النزاعات وتسويتها والمحافظة على السلام والتلاحم

الاجتماعي!

ور غبة في تعزيز الاحترام والتفاهم المشترك بين مختلن الجماعات الدينية والثقافية؛

وتاكيدأ على الأهداف والمبادئ التي كرسها الإعلان العالمي لحقوق الإنسان؛

وتشديدأ على مبادئ وفيم الكرامة والحياة الإنسائية وحقوق الإنسان والحربات الأساسية للجميع دون تميز

قانم على أسس العرق أو الجنس أو اللغة أو الدين؛

وسعيا إلى مكافحة جميع أشكال التمييز والتصنيف النمطي للأشخاص على اساس الدين والمعتقد!

وتعزيزا للتبادل المنتظم والتواصل بين ممثلي أتباع الأديان والمؤمسات القائمة على أساس العقيدة ،

والثقافة، وكذلك بين ممثلي المؤسسات الحكومية وغير الحكومية والجامعات والجهات الفاعلة في المجتمع المدني

والخبراء الأخرين من الأفراد قدر الإمكان.

وإعرابا صن تقدير ها لمبادرة خادم الحرمين الشريفين الملك ععد الد بن عبد العزيز أل سعود الرامية إلئ

تحقيق مزيد من التفاهم المشترك والتوافق على الصعيد العالمي؛

وتستذكر في هذا الصدد. أهداف ميثاق الأمم المتحدة والجهود والمبادرات الحالية الرامية إلى تحقيق

التفاهم المشترك والحوار بين أتباع الأديان والثقافات مستذكرين في هذا الصدد إعلان المؤتمر العالمي للحوار؛

المنعقد في مدريد في الثامن عشر من يولي وعام 2008م،وإعلان الاجتماع رفيع التمثيل للجمعية العامة للأمم

المتحدة حول تعريز الحوار بين انباع الأنينن والتقفت رالففامم رالتعلون من أجل السدم، المنعقد في الثلث شر

من نوفمبر عام ?2008،

ورعة في تعزيز اهافها المشتركة من حلال تاسيس مركز العلك عبد ال بن عبد العزيز العالمي للحوار

بين أتباع الأديان والثقافات (المشار إليه فيما بعد ب(" المركز")) على أسس اتفاقية متعددة الأطراف بحيث يكون

الانضمام إليها مفتوحا ومتاحا للدول والمنظمات الدولية الأخرى كاعضاء أو مراقبين.

واعترافأ بالدعم المقدم من المملكة العربية السعودية وجمهورية النمسا ومملكة اسبانيا في الإعداد لتاسيس

المركز والتزامهم طويل المدى بدعم المركز؛

واستجابة لدعوة جمهورية النمسا لجعل مقر المركز في فيينا؛

فتد اتفقت الأطراف على ما يلي:

المادة الأولى: التأسيس والشكل القانوني للمركز:

1- ينشا بموجب هذه الاتفاقية المركز باعتباره منظمة دولية.

2- يكون للمركز شخصية اعتبارية دولية.

3- يكون للمركز الأهلية القانونية للقيام بما ياتي:

أـ إبرام العقود.

ب- تملك الأموال المنقولة وغير المنقولة والتصرف فيها.

ج- اتخاذ الإجراءات القانونية والرد عليها.

د. القيام بأي عمل آخر يكون ضروريا او مفيدا لتحقيق أهداف المركز ونشاطاته.

4- يعمل المركز وفقا لهذه الاتفاقية.

المادة الثانية: الأهداف والأنشطة:

1- يهدف المركز إلى:

تعزيز الحوار بين أتباع الأديان والثقافات وتشجيع الاحترام والتفاهم والتعاون المشترك بين

النس، ودعم العدل والسلام، والتصدي لسوء استخدام الدين لتسويغ الاضطهاد والعنف

والصراع.

ب- السعي لإيجاد طريقة أفضل نكفل التعايش الديني والروحي بين الأفراد والمجتمع.

تعزيز الاحترام والمحافظة على قدسية المواقع والرموز الدينية..

معلمة التحديت المعلسرة التي تواجه المجتمع متل نللك المتعلقة بالعرامة الإنسقية، والمحافظة

طى البينة والاستخدام المستدام والامتل للموارد الطبيعية، والتربية النينية والاخدقية والحد من

الغقر .

لتحتيق هذه الأهداف، يتولى المركز عددا من المهام، منها.

1- العمل على أنه منتدى لممثلي أتباع الأديان والمؤسسات العقائدية والثقافية الرئيسة والخبراء من

أجل تعزيز التواصل وتبادل المعلومات وتسهيل التعاون.

يكون متر المركز الرئيس في العاصمة النمساوية فيينا، ويعمل في إطار الأحكام والشروط

المتفق عليها بين المركز وجمهورية النمسا.

يجوز للمركز. بحسب الحاجة إنشاء مرافق له في اماكن أخرى لدعم أنشطته.

ب- التعاون مع الجهات المعنية بالحوار بين اتباع الأديان والثقافات والجهات الأخرى والمبادرات

التي لها اهداف مشابهة، وكذلك مع الذول والمنظمات الدولية.

ج. عقد المؤتمرات وإقامة ورش العمل والنقشات وغير ذلك من الاجتماعات.

دـ القيام بانشطة أخرى تتفق مع أهداف المركز.

المادة الثالثة: المقر الرئيس:

المادة الرابعة: الأجهزة الإدارية:

يكون للمركز:

امجلس الأطراف.

- مجلس الإدارة.

- المنتدى الاستشاري.

د- الأمانة العامة.

المادة الخامسة: مجلس الأطراف؛

1- يتكون مجس الأطراف من ممثلي الأطراف في هذه الاتفاقية.

2- يتولى مجلس الأطراف القيام بما يأتي:

أ. انتخاب أعضاء محلس الادارة لمدة أريم سنوات فائلة للتمديد.

ب. اعتماد لوائح المركز المالية.

ي. اتماد برنامج عمل المركز وميزانية المركز السنوية.

د. إنشاء لجنة استشارية مقية لتقديم المشررة إلى مجلس الإدارة والألامقة في شلن المسائل

المائية المتعلقة بالميزانية.

هـ تعيين مراجعي الحسابات الخارجيين المستلين.

و- ترشيح أعضاء ممثلين من أتباع الأديان والمؤمسات العقائدية والثقافية الرنيسة لعضوية

المنتدى الاستشاري بناء على اهتراع من مجلس الإدارة.

زـالموافقة على الاتفاقيات الدولية.

الموافقة على إنشاء علاقات تعاون وفقا للمادة (العاشرة)

اعتماد قواعد الإجراءات لسجلس الأطراف.

تعدين كل من الأمين العام ونائب الأمين العام لمدة أربع سنوات قابلة للتجديد.

انتخاب مسؤولي المجس، بمن قيهم رنيسه ونائباه.

البت في شأن قبول أطراف جديدة في هذه الاتفاقية.

البت في شأن كبول أعضاء مراقبين.

يجتمع مجلس الأطراف مرة واحدة في السنة على الأقل، على الأ يقل النصاب القنوني اللازم لعقد

الاجتماع عن ثلاثة ارباع مجموع الأطراق. وبتخذ المجلس قراراته باغلبية أصوات مجموع

الأطراف، ويكون لكل طرف صوت واحد.

يتطلب انتخاب أعضاء مجلس الإدارة وفقا للنقرة (2/أ) من هذه المادة، وقبول انضمام أطراف

جديدة أو مراقبين وفتأ للفترتين (2/ل)او(2/م) من هذه المادة عدم اعتراض أي من الأطراف.

المادة السادسة: مجلس الإدارة؛

1- يتولى إدارة المركز مجلس إدارة يتألف من عدد من الأعضاه لا يزيد على الني عشر عضوأ

يمثلون أتباع الأديان الرئيسة في العالم مع مراعاة تنوعها. ويتم تمثيل اتباع الأديان المذكورة

ب. ثلاثة أعضاء عن اتباع المسيحية.

هـ عضو واحد عن أتباع البونية.

وينتخب مجلس الأطراف أعضاء مجلس الإدارة مراعيا في ذلك قدراتهم الشخصية وخبراتهم فيما

يتعلق باغراض المركز بناء على توصيات جماعتهم الدينية حسب الملائم.

يتولى مجلس الإدارة القيام بما يأتي:

تحديد الأنشطة والعمليات وتنفيذها وفقا لبرنامج عمل المركز.

تقديم اقتراح لمجلس الأطراف بترشيح أعضاء من مختلف أتباع الأديان والمؤمسات

العقائدية والثتافية الرئيسة في العالم للمنتدى الاستشاري.

المراجعة الدورية لعضوية المنتدى الاستشاري لضمان المشاركة الواسعة والناعلة لأتباع

الأديان والمؤمسات العقاندية والثقافية.

عقد اجتماعات المنتدى الاستشاري.

إيلاغ المنتدى الاستشاري بأنشطته وعملياته المخطط لها، وطلب مشورته.

إنشاء فرق عمل في المقام الأول من بين أعضاء المنتدى الاستشاري ومجلس الإدارة

لمعلجة قضايا محددة

تنسيق عمل المركز مع مراكز الحوار بين أتباع الأديان والجهات الأخرى والمبـادرات،

وكذلك من خلال التعاون الوثيق مع الأمين العام ومع الدول والمنظمات الدولية.

تكوين اللجان اللازمة لتمكين المركز من أداء مهماته بكفاية،بالتعاون الوثيق مع الأمين

العام.

اعتماد قواعد الإجراءات لمجلس الإدارة.

انتخاب رئيس مجلس الإدارة ونائب الرئيس.

يجتمع مجلس الإدارة مرة واحدة في السنة طى الأفل، وبكون النصاب الققوني للاجتماع

حضور ثلاثة أرباع من مجموع أعضائه، ويتخذ مجلس الإدارة قراراته بأغلبية أصوات

أعضائه، ويكون لكل عضو في المجلس صوت واحد..

لأعضاء مجلس الإدارة الاستقالة في أي وقت بموجب إشعار كتابي يقدم إلى مجلس الإدارة.

وتكون هذه الاستقالة نافذة عند تسلم مجلس الإدارة لها.

المادة السابعة: المنتدى الاستشاري:

١ ١:

1. يقوم المنتدى الاستشاري بدعم انشطة مجلس الإدارة وتقديم المشورة في شلن برنامج صل مجلس

الإدارة ومضمون الشملة المرمر. وبنكف المنتدى الامستشري من عد يمل بجى مز مسو من ممشي

اتباع الأديان والمؤسسات العقائدية والثقافية الرئيسة في العالم، يتم ترشيحهم وفقا للفقرة (2/ و) من

المادة (الخامسة) لمدة أربع سنوات قابلة للتجديد، مع مراعاة الحاجة إلى ضمان وجود أعضاء من جميع

انحاء العالم.

2- لأعضاء المنتدى الاستشاري الذين يعملون بصفة فردية ومستقلة الحق في تقديم الاستقالة فـي أي

وقت عن طريق إشعار خطي يرسل إلى مجلس الإدارة.

يجتمع المنتدى الاستشاري. بدعوة من مجلس الإدارة مرة واحدة في السنة على الأقل. ويكون

النصاب القانوني لحضور اجتماعاته حضور اغلبية الاعضاء على الأقل. ويعتمد المنتدى الاستشاري

توصياته بالإجماع قدر الإمكان، وعند تعذر ذلك، تعتمد التوصيات بأغلبية ثلثي اعضانه،ويكون لكل

عضو صوت وأحد. ويجوز لأعضاء مجلس الإدارة حضور اجتماعات المنتدى الاستشاري. ويعتمد

المنتدى الاستشاري قواعد الإجراءات الخاصة به وينتخب مسؤوليه، بعن فيهم رنيسه ونائبه.

المادة الثامنة: الأمئة العامة:

تتولى الأمانة العامة مساعدة الأجهزة الإدارية الأخرى التابعة للمركز في تنفيذ أنشطتها ومهماتها،

ويكون للأمانة فريق عمل دانم ومستقر في فيينا.

يراس الأمانة امين عام مسؤول عن إدارة الأعمال اليومية للمركز. ويعمل الأمين العام تحت سلطة

مجلس الإدارة ومجلس الأطراف، ويكون مسؤولأ أمام مجلس الأطراف.

يتولى الأمين العام- على وجه خاص- الأعمل الأتية:

تمثيل المركز خارجيا.

ضمان الإدارة المناسبة للمركز، بما في ذلك الموارد البشرية والإدارة المالية.

ج. اقتراح الميزانية السنوية وبرنامج العمل لاعتمادهما من مجلس الأطراف بعد استشارة مجلس

إبرام العقود والترتيبات باسم المركز، والتفاوض في شان الاتفاقيات الدولية لاعتمادها من مجلس

الاحطراف.

اقتراح إقامة علاقات تعاون وفقا للمادة (العشرة) لاعتمادها من مجلس الأطراف.

الاجتهاد في البحث عن التمويل المناسب للمركز وقبول الإسهامات التطوعية نيابة عن المركز

وفقا للوائح الملية.

الاضطلاع بالمهام او الأنشطة الأخر ى، التى يحددها محلسا الادارة.

المادة التاسعة: التمويل:

تشمل موارد المركز ما باتي.

أ. الإسهامات التطوعية التي يقدمها الأطراف والمراقبون.

ب- الإسهامات والتبرعات التي تقدمها مصادر أخرى مناسبة.

ج- الإيرادات الأخرى، التي من ضمنها العوائد المستحقة عن الإسهامات.

تكون السنة الملية للمركز من I يناير إلى 31 ديسمبر.

تخضع حسابات المركز وشؤونه المالية لمراجعة سنوية خارجية مستقلة وفقا للمعايير والأنظمة المالية

الدولية.

المادة العاشرة: علاقات التعاون؛

للمركز إقامة علاقات تعاون مع الجهات العامة أو الخاصة التي يمكن أن تسهم في عمله.

المادة الحادية عثرة: المزايا والحصانات؛

1- يتمتع المركز، وأعضاء مجلس الإدارة، وأعضاء المنتدى الاستشاري. والأمين العام، وغيره من

منسوبي الأمانة والخبراء؛ بالمزايا والحصائات التي يتفق عليها المركز وجمهورية النمسا.

2- للمركز أن يبرم اتفاقيات مع نول اخرى من أجل الحصول على المزايا والحصائات المنسبة.

المادة الثانية عشرة: المسؤولية؛

ر- لا يلزم أي طرف من أطراف هذه الاتفاقية بتوفير الدعم المالي للمركز ر الإسهامات التي تعهد بها.

2- أطراف هذه الاتفاقية غير مسؤولين، مجتمعين أو منفردين، عن أي تين أو مطالبة، أو اي التزام أخر

طى المرعز؛ ويجب تضمين نص صريح بهنا المعنى في عل اتفاقبة يبرمها المرعز بموجب المادة

(الحادية عشرة).

المادة الثالثة عشرة: التعديلات.

لا بجوز تعديل هذه الاتفاقية إلا بموافقة جميع الأطراف، عطى ان بتم إشعار جهة الإيداع خطيا بهذه

الموافقة ودخل اى، تعديل حيذ النفذ عند تسلم حية الإيداع إشعارأ من جمع الأطراف فى هذه الاتغاقيـة، اوفى اى

المادة الرابعة عشرة: الأحكام الانتقالية؛

تؤول الحقوق والواجبات للأعمال التي تم الدخول فيها من خلال الأجهزة المؤقتة للمركز حيث ما

كان ذلك مناسبا إلى المركز حال بدء نفاذ هذه الاتفاقية.

يتالف مجلس الإدارة الأول من تسعة أعضاء.

المادة الخامسة عشرةوالنفاذ وجهة الإيداء؛

تدخل هذه الاتفاقية حيز النفاذ بعد ستين يومأ من تاريخ إيداع الدول الموقعة على الاتفاقية وثـئق

التصديق، أو القبول، أو الاعتماد.

للدول والمنظمات الدولية التي لم توقع على هذه الاتغاقية الانضمام إليها لاحقا بعد موافقة مجلس

الأطراف على قبولها وفقا للفترة (4) من المادة (الخامسة).

تدخل هذه الاتفاقية حيز النفاذ بالنسبة إلى أي دولة أو منظمة دولية تنضم إليها بعد نفاذها، بعد ستين

يوما من تاريخ ايداع وثيقة الانضمام.

يتولى الوزير الفدرالي للشؤون الأوروبية والدولية لجمهورية النمسا القيام بعمل جهة الإيداع لهذه

الاتفاقية.

المادة السادسة عشرة: المراقبون

يجوز لأي دولة أو منظمة دولية الانضمام لهذه الاتفقية بصفة عضو مراقب في المركز بعد موافقة مجلس

الأطراف على قبولها وفقا للفقرة (4) من المادة (الخامسة). ويجوز لممثلي العضو المراقب حضور اجتماعات

مجلس الأطراف والتحدث فيها وفقا لتواعد الإجراءات المعمول بها ووفقا لشروط واحكام هذه الاتفاقية.

المادة السابعة عشرة؛ تسوية النزاعات:

يسوى أي نزاع ينشا بين المركز وأي طرف في هذه الاتفاقية أو بين أي من اطراف هذه الاتفاقية من

خلال التفاوض أو أي وسيلة أخرى للتسوية بتفق عليها.

المادة الثامنة عشرة: الانسحب من الاتفاقية:

1- لأي من أطراف هذه الاتفاقية الانسحاب منها بموجب إشعار كتابي إلى جهة الإيداع. ويصبح هذا

الانسحاب نافذا بعد ثلاثة أشهر من تسلم جهة الإيداع الإشعار.

2- انسحاب أي طرف من هذه الاتفاقية لا يحد أو يقلل أو يؤثر بأي شكل من الاشكال عطى إسهام هذا

المادة التاسعة عشرة: الإنهاء:

بجوز لأطراف هذه الاتفاقية في أي وقت إنهاء هذه الاتفاقية بالإجماع وتصفية المركز بموجب إشعار

كتابي إلى جهة الإيداع. ويتم التصرف في الأصول الباقية للمركز بعد دفع التزاماته القانونية وفقا لقرار

الأغلبية في مجلس الأطراف.

تبقى أحكام هذه الاتفاقية سارية المفعول بعد إنهائها إلى المدى اللازم الذي يسمح بالتصرف في أصول

المركز وتسوية حساباته.

أبرمت هذه الاتفاقية في فيننا، النمسا، بتاريخ 13 أكتوبر 2011 وحررت باللغات: العربية، والصينية،

والإنجليزية، والفرنسية، والروسية، والأسبانية، وجميعها متساوية فقي الحجية.
