ويعد الاطلاع على قرار مجلس الشورى رقم (١٩/٣٦) بتاريخ
١٤٣٣١٥١١٠ ف.
ويعد الاطلاع على قرار مجلس الوزراء رقم ( (٢ ) بتاريخ ١٤٢٣/١١/١ف.
رسمنا بما هو آت:
أولا : الموافقة على اتفاتية تعاون بـين حكومة المملكة العربية السعودية وحكومة جمهورية
الارجنتين في مجال الاستخدامات السلمية للطاقة النووية، الموقعة في مدينة الرياض
بتاريغ ٣٦ /٤٣٢/٧ ١ مـ الموافق ٢٠١١/٦/٢٨ ، بحسب
الصينة المرافقة.

إن مجلس الوزراء
بعد الاطلاع على المعاملة الواردة من الديوان الملكي برقم ٢٥٥٤٨ وتاريخ ٢٢/ ٥/ ٤٣٣ ١ ه، المشتملة
على خطاب معالي رئيس مدينة الملك عبد الله للطاقة الذرية والمتجددة رقم ١٣٩/١/ب وتاريخ
1٤٣٢/٨/٣هـ، في شأن طلب معاليه التصديق على مشروع اتفاقية تعاون بين حكومة المملكة العربية
السعودية وحكومة جمهورية الأرجنتين ف مجال الاستخدامات السلمية للطاقة النووية .
ويعد الاطلاع على مشروع الاتفاقية، المشار إليه .
وبعد الاطلاع على قرار مجلس الوزراء رقم (١٢٢) وتاريخ ١٤٣٢/٤/٢٣هـ.
وبعد الاطلاع على المادة (٧٩) من اتفاقية (فيينا) لقانون المعاهدات لعام (١٩٦٩ م) ،
المصدقة بالمرسوم الملكي رقم (م/٥؟) وتاريخ ١٤٢٣/٦/٢٥هـ .
وبعد الاطلاع على المحضر رقم (٤٠١) وتاريخ ٤٣٢/٩/٣٣ ١هـ، المعد في هيئة الخبراء بمجلس الوزراء.
وبعد النظر في قرار مجلس الشورى رقم (١٩/٣٦) وتاريخ ١٤٣٣/٥/١٠هـ.
وبعد الاطلاع على توصية اللجنة العامة لمجلس الوزراء رقم (٤٦٨) وتاريخ ١٤٣/٦/٢هـ.
ما
يقررما يلي :
أولا: الموافقة على اتفاقية تعاون بين حتومة المملكة العربية السعودية وحتومة جمهورية
الأرجنتين في مجال الاستخدامات السلمية للطاقة النووية، الموقعة ف مدينة الرياض
ا
بتاريخ ١٤٣٢/٧/٢٦ه، الموافق ٢٠١١/٦/٢٨ م، وذلك بالصيغة المرافقة.
وقد أعد مشروع مرسوم ملكي بذلك ، صيغته مرافقة لهذا .
ثانيا: قيام مدينة الملك عبدالله للطاقة الذرية والمتجددة بالتنسيق مع الجانب الأرجنتيني لإجراء
التصحيحات اللازمة على ترقيم فقرات المواد (٨) و(١٠) و(١١) من النسخة الانجليزية من
الاتفاقية لتكون أرقاما بدلا من الأحرف ، وذلك باتباع إجراءات التصحيح المنصوص عليها ف
الفقرة (١/أ) من المادة (٧٩) من اتفاقية (فيينا) لقانون المعاهدات لعام (١٩٦٩م) .

لإجراء التصحيحات اللازمة على ترقهم فقرات المواد (٨)و(١٠) و(١١) من النسخة الانجليزية
من الاتفاقية لتكون أرقاما بدلا من الاحرف، وذلك باتباع إجراءات التصحيح المنصوص عليها في
الفقرة (١/أ) من المادة (٧٩) من اتفاقية (فيينا) لقائون المعاهدات لعام (١٩٦٩)).
وحيث صدر المرسوم الملكي الكريم رقم (م/٧٤) بتاريخ ٣ ١٤٣٣/١١هـ (المرفق
صورة منه) بالمصادقة على ما ورد في الفقرة (١) من القرار ، كما تمت الموافقة الكريمة علـى
الفقرة (٢) منه ..آمل إكمال اللازم بموجبه، علما بان الامانة العامة لمجلس الوذداء أفادت بكتابها
رقم ٥ ٢١٤ بتاريخ ١٤٣٣/١١/٢ م - المشار إليه أعلاه - بأن المجلس الموقر وجه بأن تقوم

اتفاقية تعاون
بين حكومة المملكة العربية السعودية
و حكومة جمهورية الأرجنتين
في مجال الاستخدامات السلمية للطاقة النووية
إن حكومة المملكة العربية السعودية و حكومة جمهورية الأرجنتين ، (المشار إليهما فيما بعد بـ
"الطرفين ") :
اخذتين في الاعتبار مزايا التعاون الفعال بينهما في تطوير واستخدام الطاقة النووية للأغراض السلمية؛
ورغبة في إرساء الإطا القا : اللا لذلك؛

وأملا في تعزيز وتطوير التعاون في المجالات العلمية والتقنية والاقتصادية ذات المنفعة المتبادلة بين
الطرفين، على أساس قائم على الاحترام المتبادل لسيادة كل منهما، والمعاملة بالمثل، واحترام البرامج النووية
لكل منهما
واعترافا بأهمية الطاقة النووية لتلبية الطلب العالمي المتزايد على الطاقة بشكل ملحوظ وفعال ؛
وبملاحظة أن الطرفين عضوان في الوكالة الدولية للطاقة الذرية المشار إليها فيما بعد بـ (IAEA)،
وهما أيضا طرفا: ف معامدة عد انتخار الأسلعة النوونة ف ١ بولدو ١٩٦٩)

وإبرازا لدعمهما لنظام الضمانات التابع للوكالة الدولية للطاقة الذرية وأهميته في ضمان أن التعاون
الدولي في مجال استخدام الطاقة النووية للأغراض السلمية سينفذ في إطار المعاهدات التي لن تسهم في انتشار
الأسلحة النووية أو الأجهزة النووية المتفجرة الأخرى ،
وتذكيرا بأن الطرفين عضوان في اتفاقية الحماية الادية للمواد النووية في ٣ يونيو ١٩٨٠ واتفاقية التبليغ
البكر عن وفوع حادث نووي في ٢٦ سبتمبر ١٩٨٦ واتفاقية تقد. المساعدة في حالة وقوع حادث نووي أو طارئ
إشعاعي في ٢٦ سبتمبر ١٩٨٦،
ورغبة في تعزيز التعاون في مجال استخدام وتطوير الطاقة النووية للأغراض السلمية بطريقة شفافة

وعائدة بالفائدة على الجميع .
فقد اتفقتا على ما يلي :

المادة الأول
التعاون العلمي والتقني والاقتصادي بين الطرفين في مجال
(- تهدف هذه الاتفاقية إلى تطوير وتعزي:
الاستخدامات السلمية للطاقة النووية وفقا للاحتياجات والأولويات لبرامجهما النووية الوطنية ، ولقوانينهما
الداخلية، والتزاماتهما وتعهداتهما الدولية، وعلى أساس من المنفعة المتبادلة والمساواة والمعاملة بالمثل.
لأحكا هذه الاتفاقية المواد النووية والمواد والمعدات والمكونات والتقنية التبادلة بين البلدين .
٢- تخضع مر
٣- لا تؤثر أحكام هذه الاتفاقية على الالتزامات والتعهدات الدولية للطرفين .
المادة الثانية
يتعأون الطرفان بموجب هذه الاتفاقية في المجالات التالية
أ - البحوث الأساسية والتطبيقية في مجال الاستخدامات السلمية للطاقة النووية.
- إنتا واستخدام النظائر المشعة في الصناعة والطب والزراعة.
التنقيب عن المواد النووية واكتشافها.

ما
د ـ تطوير وتصميم وبناء وتشغيل وصيانة محطات الطاقة النووية ومفاعلات الأبحاث،
:
مـ بحث وتطوير وتصميم وإنتاج وإمداد الوقود النووي لمحطات الطاقة النووية ومفاعلات البحوث.
- الانتاج الصناعي للمكونات والمواد اللازمة للاستخدام في المفاعلات النووية والوقود النووي.
معالجة النفايات المشعة وإدارتها.

طـ الحماية من الإشعاع، والسلامة النووية، والأنظمة الخاصة بهما.

المادة الثالثة
يتخذ التعاون في المجالات المذكورة في المادة (الثانية) الأشكال التالية .
- المساعدة المتبادلة المتعلقة بالتعليم والتدريب العلمي والتقني للأفراد .
- تبادل الخبراء، والعلماء، والفنيين والمحاضرين .
تبادل المعلومات.
تبادل المشاورات حول المشكلات العلمية والتقنية.
هـ - تنفيذ دراسات مشتركة حول مشاريع البحث العلمي والتطوير التقني.
- تبادل المواد النووية في أي شكل من الأشكال والمعدات والخدمات المرتبطة بالمجالات المذكورة في الادة

(الثانية) من هذد الاتفاقية.
أ- شكل من أشكال التعاون يتفق عليه الطرفان.

المادة الرابعة
تكون الجهات المختصة بهذه الاتفاقية على النحو الآتي
بالنسبة إلى المملكة العربية السعودية: مدينة الملك عبدالله للطاقة الذرية والمتجددة .

١ - يشكل الطرفان لجنة مشتركة بينهما للتنسيق من أجل ما يلي :

أ ـ متابعة تنفيذ هذه الاتفاقية.
- النظر في القضايا الناشئة من تنقيدها.

ج ـ إجراء مشاورات حول القضايا ذات الاهتمام المشترك المتعلقة بالاستخدامات السلمية للطاقة النووية.
٢ - تتكون اللجنة المشتركة من
أ - بالنسبة إلى المملكة العربية السعودية: مدينة الملك عبدالله للطاقة الذرية والمتجددة ،
- بالنسبة إلى جمهورية الأرجنتين: الهيئة الوطنية للطاقة الذرية (CNEA) ، وهيئة الرقابة النووية
(ARN)، وفقا لاختصاصات كل منهما .
٣- تعقد اللجنة الشتركة اجتماعاتها عندما يتفق الطرفان على ذلك بالتناوب في بلد كل طرف، ويكون كل طرف
مسؤولا عن جميع
التكاليف المترتبة على حضوره هذه الاجتماعات.
المادة السادسة
يكون التعاون في المجالات النصوص عليها فى الادة (الثانية) من هذه الاتفاقية بين الجهات ذات العلاقة لدى
كل من الطرفين بناء على موافقة لجنة التنسيق المشتركة وتحت إشرافها ومن خلال ما يلي:
أ ـ برا . تنفيذية تبرم في إطار هذه الاتفاقية.
ب عقود تبرم بين الهيئات، والشركات، والمعاهد ذات العلاقة الخاضعة لولاية وسيطرة أي من الطرفين.

المادة السابعة

م كل طرف ـ وفقا لقانونه الداخلي ـ الحماية الفعالة لحقوق الملكية الفكرية واستخدامها ، المنقولة أو المنشأة
بموجب هذه الاتفاقية، ويتم تنظيم موضوعات الحماية واستخدام حقوق الملكية الفكرية من خلال برامج تنفيذية

أو عقود تبرم بين الطرفين .
المادة الثامنة
- لا تلزم هذه الاتفاقية بنقل أي معلومة لا تسمح القوانين الوطنية لأي من الطرفين بنقلها.
"- المعلومات المقدمة بموجب هذه الاتفاقية، أو الناتجة عن تنفيذها، أو يعتقد أحدالطرفين أنها حساسة أو
سرية ، تصنف وتحدد بوضوح بحسب

ج المعلومات السرية أو الحساسة يتم التعامل معها وفقا للقانون الداخلى المعمول به في بلد الطرف المتلقي . ولا
يجوز الكشف عن هذه العلومات أو نقلها إلى طرف ثالث غير مشارك في تنفيذ هذه الاتفاقية ، من دون موافقة
كتابية مسبقة من الطرف المزود.
المادة التاسعة
يضمن الطرفان عدم استخدام المواد والتقنيات النووية الخاضعة لهذه الاتفاقية وكذلك المواد النووية التي
الأسلحة النووية وغيرها من الأجهزة المتفجرة النووية أو في أي غرض
تنتج منها أو نتيجة استخدامها في صنع
عسكري.
المادة العاشرة
١- المواد النووية المنقولة إلى أي من الطرفين وفقا لهذه الاتفاقية وأي من المواد النووية التي تنتج من خلال
استخدام أي مادة أو معدة ، وكذلك نقل التقنية ، يجب أن تخضع للاتفاق الذي وقعه كل من الطرفين مع
الوكالة الدولية للطاقة الذرية (IAEA) لتطبيق الضمانات على الأنشطة النووية داخل أراضيه أو
الخاضعة لولايته القضائية أو تحت سيطرته في أي مكان .
٢- يتخذ كل من الطرفين ما يلزم من تدابير للمحافظة على الضمانات المنصوص عليها في الفقرة (١) من هذه
المادة ، وتسهيل تطبيقها .
٣- تنفذ شروط هذه الادة، على نحو يحد من التدخل غير الضرورى في الأنشطة النووية لأى من الطرفين،
مع الممارسات الإدارية الحكيمة اللازمة لتنفيذ برامجهما النوويه المستخدمة في الأغراض

السلمية بطريقة اقتصادية وامنة.
؛- إذا تبين لأي من الطرفين ما يوضح أن الوكالة الدولية للطاقة الذرية (IAEA) لأي من الأسباب لا
تطبق أو لن تطبق الضمانات المتفق عليها طبقا لملا هو مبين في الفقرة (١) من هذه الادة من أجل ضمان
الاستمرار الفعال للضانات، فعلى الطرفين أن يبدا المشاورات بشكل عاجل من أجل توفير الضمانات
اللازمة المنصوص عليها في هذه المادة.
المادة الحادية عشرة
أ- يحتفظ الطرفان بالحماية المادية بالنسبة إلى نقل المواد النووية وفقا لهذه الاتفاقية وكذلك بالنسبة إلى
إنتاج مواد نووية من خلال استخدام الواد النووية أو العدات التي تخضع لهذه الاتفاقية ، عند مستويات
لا تقل عن تلك التي أوصت بها الوكالة الدولية للطاقة الذرية .
٢ - يكون كل طرف مسؤولا عن تنفيذ وصيانة مقاييس الحماية المادية للمواد النووية على أراضيه.

المادة الثانية عشرة
على كل طرف الحصول على الموافقة الخطية المسبقة من الطرف الآخر في الحالات التالية:
١- قبل تحويل أي مادة نووية أو مواد أو معدات أو تقنيات خاضعة لهذه الاتفاقية ، أو أي مواد نووية
منتجة عن طريق استخدام مواد نووية أو معدات تخضع لهذه الاتفاقية خارج ولاية دولة طرف في هذه
الاتفاقية إلى طرف ثالث .
تخصيب أي مادة نووية خاضعة لهذه الاتفاقية أو منتجة عن طريق استخدام المواد النووية أو

المعدات الخاضعة للاتفاقية إلى عشرين في المائة أو أكثر في نظير اليورانيوم - ٢٣٥، أو قبل إعادة معالجة
للاتفاقية أو منتجة عن طريق استخدام مادة نووية أو معدات تخضع
للاتفاقية .

المادة الثالثة عشرة
أي نزاع ينشأ من تفسير هذه الاتفاقية أو تطبيقها يحل بالطرق الودية عن طريق التفاوض بين الطرفين.

المادة الرابعة عشرة

النفاذ منذ تارين آخر إشعار كتابي متبادل بين الطرفين عبر القنوات
تدخل هذه الاتفاقية حيز
الدبلوماسية يعلم فيه اكتمال كل الإجراءات الداخلية اللازمة لدخولها حيز النفاذ .
٢- تظل هذه الاتفاقية سارية المفعولة لمدة عشرين (٢٠) سنة ، وتتجدد تلقائيا لمدد متتالية مدة كل منها
عشر (١٠) سنوات، ما لم يقدم أحد الطرفين إشعارا كتابيا للطرف الآخر عبر القنوات الدبلوماسية

٣- يمكن تعديل هذه الاتفاقية بموافقة الطرفين ، وتدخل التعديلات حيز النفاذ وفقا

للفقرة (١) من هذه المادة

؛ - يمكن لأي من الطرفين إنهاء هذه الاتفاقية في أي وقت، من خلال إشعار كتابي
يقدم إلى الطرف الآخر قبل ستة (1) أشهر على الأقل من تاريخ الإنهاء .
ه- إنهاء الاتفاقية لن يؤثر على تنفيذ الترتيبات أو العقود التي تمت خلال مدة صلاحيتها ولم تستكمل
بحلول موعد إنهائها .
- في حالة إنهاء هذه الاتفاقية ، فإن الالتزامات الواردة في المواد ( التاسعة ، والعاشرة ، والحادية عشرة
، والثانية عشرة) منها تظل سارية المفعول ، إلا إذا اتفق الطرفان على غير ذلك .

سبق ، وقع المفوضان من حكومتيهما هذه الاتفاقية
حررت في مدينة الرياض يوم الثلاثاء بتاريخ ٦ رجب ٣٢؛هـ، الموافق ٨ يونيو ٢٠١١ م، من
نسختين أصليتين باللغات : العربية ، والإسبانية ، والإنجليزية والنصوص الثلاثة متساوية الحجية ، وفي حالة
الاختلاف في تفسير أحكامها ، فإن النخة الإنجليزية تكون هي المرجع
