إن مجلس الوزراء
بعد الاطلاع على المعاملة الواردة من الديوان الملكي برقم ٥٤٦٨ وتاريخ ٤٢٦/٢/٦اد، المشتملة
على برقية صاحب السمو الملكي وزير الداخلية رقم ٤٨١٥٦ وتاريخ ١٤٣٥/٧/٢٧هـ، في شان طلب
التصديق على مشروع اتفاقية للتعاون في المجالات الأمنية ومكافحة الجريمة بين المملكة
العربية السعودية ومملكة إسبانيا التي تم توقيعها بناء على الأمرين الساميين رقم (٧٧٩٩/ م ب )
وتاريخ ٤٣٠/٩/٢٢اه ورقم (٢٨٣٦٦ ) وتاريخ ٤٣٥/٧/١٩اه
وبعد الاطلاع على مشروع الاتفاقية المشار إليه.
وبعد الاطلاع على المحضر رقم (٥٦٤) وتاريخ ١٤٣٥/٩/١١ه، المعد في هينة الخبراء بمجلس الوزراء.
وبعد النظر في قرار مجلس الشورى رقم (٦٩/١٢٩ ) وتاريخ ٤٣٦/١/٢٥اهـ
وبعد الاطلاع على توصية اللجنة العامة لمجلس الوزراء رقم (٢٠٦) وتاريخ ١٤٣٦/٢/١٦ه.

إن المملكة العربية السعودية ومملكة إسبانيا (المشار إليهما فيما بعد
بالطرفين)؛
رغبة منهما في تقوية علاقات الصداقة والتعاون بينهما؛
وإيمانا بتطوير هذه العلاقات، وبتعزيز التعاون بينهما في مجالات حفظ
الأمن ومحاربة الجريمة، وبتحسين أداء سلطاتهما الأمنية؛
وإدراكا منهما للتهديد الخطير للإرهاب الدولي، والجريمة المنظمة وغيرها
من أشكال الانتهاكات للنمو الاجتماعي والاقتصادي والأمن العام في البلدين؛
وإذ يتقيدان بالتشريعات الوطنية الخاصة بكل منهما، مع الآخذ بالاعتبار

المادة الأولى

يتعاون الطرفان في حفظ الأمن ومكافحة الجريمة بجميع أشكالها، وبخاصة
الجرائم التالية:
أ) الجرائم المتعلقة بالإرهاب، وتموبله ودعمه.
ب) جرائم القتل والاعتداء على النفس والسلامة الجسدية للأشخاص.
ج) جرائم الخطف واحتجاز الرهائن واختطاف الأطفال.

المتفجرة والمواد الكيميائية والبيولوجية والإشعاعية وغيرها من المواد
الخطيرة، والتقنية ذات الاستخدامات المزدوجة، والخدمات والسلع ذات
العلاقة.
جرائم الإنتاج والتهريب والاتجار بالمخدرات والمؤثرات العقلية غير

الجرائم المتعلقة بالفساد.
جرائم غسل الأموال.
جرائم التزوير بجميع أشكاله.
جرائم تزييف العملات.
جرائم الاتجار غير المشروع في المركبات والأنشطة الإجرامية المرتبطة

الجرائم الجنسية ضد القاصرين، وإنتاج المواد الإباحية التي يشارك
قيها قاصرون، ونشرها وتزويد الغير بها.
الجرائم المتعلقة بالهجرة غير المشروعة والاتجار بالأشخاص.
جرائم الاتجار غير المشروع بالممتلكات الثقافية ذات القيمة التاريخية
والأعمال الفنية.
الجرائم المعلوماتية، والجرائم المتعلقة بتقنية المعلومات وشبكات
الأنظمة.

١. يعمل الطرفان بناء على اتفاق مشترك - على التعاون المتبادل في مكافحة
أي نوع آخر من الجرائم التي يتطلب منعها أو كشفها أو التحقيق فيها تعاون
الجهات المختصة في البلدين.
٢. يمكن للطرفين بناء على اتفاق مشترك التعاون المتبادل في أي من
المجالات الأمنية الأخرى، بشرط أن يكون ذلك متوافقا مع أغراض هذه
الاتفاقية.
المادة الثانية
يتعاون الطرفان ضمن إطار هذه الاتفاقية على تقديم المساعدة وتبادل
المعلومات في شأن ما يلي:
١. البحث والتعرف على المفقودين أو الأشخاص الذين يعتقد أنهم توفوا أو الذين
ثبتت وفاتهم لأسباب طبيعية أو غير طبيعية، وكذلك الجثث التي تكون
موضع اهتمام السلطات المختصة.
٢. البحث والتحري عن الأشخاص الذين ارتكبوا أو يشتبه في ارتكابهم
جرائم، وكذلك التحري عن أماكن إقامتهم وأنشطتهم في أي من البلدين.
٣. البحث والتحرى عن المواد أو الأموال المنقولة أو الأدوات المرتبطة بأنشطة

والتي تشكل موضع اهتمام للطرف الآخر.
٥. منظمات الجريمة المنظمة، وكذلك هيكلها وعملياتها وأساليبها وعناصرها
واتصالاتها وأنشطتها الإجرامية والتحقيقات بشأنها.
٦. تمويل أنشطة الإرهاب والجريمة المنظمة عبر الوطنية.

٧. المنظمات والجماعات الإجرامية التي تعد أي نشاط تخريبي يهدف إلى
المساس بأمن أي من البلدين أو مصالحه الاقتصادية، أو تخطط له، أو تشارك
في تنفيذه، أو تنوي ذلك.
٨. الاتجار غير المشروع في عينات النباتات والحيوانات الواردة في اتفاقية
التجارة الدولية في الأنواع المهددة بالانقراض من مجموعات الحيوانات
والنباتات البرية (CITES)، والنفايات الخطرة، ومنتجات الصحة
النباتية، وغيرها من المواد التي تؤتر أو قد تؤتر على البينة.
٩. الرصد والتسليم المراقب للمخدرات والمؤثرات العقلية غير المشروعة.
الاتجار غير المشروع في المواد المشعة أو المتفجرة أو السامة والأسلحة،
وتهريبها.
تسهيل العبور عن طريق الترانزيت للأشخاص المبعدين أو الذين يتم

الطرف المتهم أو الشهود أو الضحايا في إقليم أحد الطرفين.

ممارسة الرقابة الأمنية على الأشخاص والبضائع في موانئ ومطارات كل طرف
سواء كانت وجهتها النهائية إلى الطرف الآخر، أو تمر عن طريق الترانزيت
إلى الطرف الآخر، وذلك لمنع التهريب والاتجار غير المشروع وكشفه، وكذلك
كشف الأشخاص المشتبه فيهم أو المتورطين في الأنشطة الإجرامية ذات
العلاقة، وتبادل المعلومات في هذا الشأن.

المادة الثالثة
١. يعمل الطرفان من أجل تحقيق التعاون في المجالات المشمولة في هذه
الاتفاقية على ما يلي:
أ) تبادل المعلومات عن استخدام التقنية الحديثة وكذلك الإجراءات
الالكترونية والرقمية في أساليب التحقيق الجنائي، والحصول على
الأدلة عبر تلك الوسائل.
ب) تبادل المنشورات والمطبوعات ونتائج البحوث العلمية في المجالات الواردة
في هذه الاتفاقية.
ج) تقديم المساعدة الفنية والعلمية، وأساليب معاينة الخبراء، وإعارة
الكوادر الفنية المتخصصة والمعدات والوسائل.
د) تبادل المعلومات حول الأدوات التشريعية والفنية والعملياتية، وتقديم
استشارات الخبراء فيما يتعلق بمكافحة الإرهاب والجريمة المنظمة.
ه) تبادل المعلومات المتعلقة بالمؤتمرات والندوات والمنتديات العلمية المتعلقة
بمكافحة الإرهاب والجريمة المنظمة.
و) تبادل الخبراء لحضور اجتماعات لمناقشة المسائل ذات المصلحة المشتركة.
٠. يمكن للطرفت الاتفاق على أي أشكال أخرى للتعاون.

المادة الرابعة
يتعاون الطرفان في مجال التدريب الأمني في النواحي التالية:
٢. البرامج والدورات التدريبية.
٤. تبادل اللقاءات والزيارات.
٥. المؤتمرات والمعارض والندوات العلمية.
٦. تبادل الوسائل الإيضاحية والتدريبية المتوافرة لدى كل منهما.

المادة الخامسة
يلتزم كل طرف بالمحافظة على سرية المعلومات المستلمة من الطرف الآخر
بناء على أحكام هذه الاتفاقية، واستخدامها في حدود الغرض الذي طلبت المعلومات
من أجله. ويلتزم كذلك بعدم تمريرها إلى طرف ثالث دون الحصول على موافقة
كتابية من الطرف الذي أرسلها.
المادة السادسة
يتم تبادل المعلومات بين الطرفين بموجب هذه الاتفاقية وفقا لما يلي:
يقوم الطرف الذي طلب المعلومات باستخدامها في الغرض الذي طلبت من أجله
فقط ووفقا للشروط التى يحددها الطرف المرسل، مع الآخذ في الاعتبار المدة
الزمنية النهائية التي يتعين إتلافها بعدها وفقا لتشريعاته الوطنية.
بناء على طلب أحد الطرفين، يقوم الطرف الآخر بتقديم معلومات عن
استخدام البيانات التي سبق أن سلمت إليه وعن النتائج المحققة.
إذا حصل أن أرسلت بيانات خاطئة أو غير كاملة، فعلى الطرف الذي أرسلها
إشعار الطرف الطالب دون تأخير.
يحتفظ كل من الطرفين بسجل للتقارير المتعلقة بالمعلومات المرسلة، ويتلفها
قور انتهاء الغرض من استخدامها.
المادة السابعة
عند معالجة البيانات الشخصية بموجب هذه الاتفاقية، تتقيد السلطات

المتصلة بالمعالجة الآلية لبياناتهم، بالإضافة إلى التشريعات الوطنية الخاصة

المادة الثامنة
١. الأجهزة المختصة بتنفيذ هذه الاتفاقية هي:
من جانب المملكة العربية السعودية: وزارة الداخلية.
من جانب مملكة أسبانيا: وزارة الداخلية دون الإخلال بالاختصاصات التي
تندرج تحت مسؤولية وزارات أخرى.
٢. يقوم كل طرف بإبلاغ الطرف الآخر عبر القنوات الدبلوماسية عن أي تغيير
لأجهزته المختصة.
المادة التاسعة
١. يمكن لكل من الطرفين - من أجل تشجيع التعاون وتعزيزه وللتطبيق المناسب
لهذه الاتفاقية - تعيين ملحقين أو ضباط اتصال في إقليم الطرف الآخر،
وذلك لمدة محددة أو غير مهدة. مى
٢. يقوم الملحقون أو ضباط الاتصال بتوفير المعلومات وأداء مهمات أخرى بناء
على تعليمات الطرف الذي عينهم، وينفذون - في حدود اختصاصهم
طلبات المساعدة التي قدمتها الجهات المختصة في إقليم الطرف الذي عينوا
فيه. وعند أدانهم مهماتهم عليهم التقيد بالتشريعات الوطنية للدولة التي

١. ترسل المعلومات المتبادلة وطلبات تنفيذ الأنشطة الواردة في هذه الاتفاقية
كتابيا مباشرة إلى السلطات المختصة وعبر الملحقين وضباط الاتصال - إن
وجدوا - أو مكاتب الاتصال الوطنية للشرطة الدولية في البلدين. وفي
الحالات العاجلة، يمكن مقدما للسلطات المختصة تقديم معلومات بصورة

شفهية وذلك من أجل التقيد بهذه الاتفاقية، وتؤكد الإجراءات الشكلية
كتابيا بعد ذلك فورا.
٢. تنف الجهات المختصة طلبات تبادل المعلومات أو طلبات تنفيذ الأنشطة
الواردة في هذه الاتفاقية في أقصر وقت ممكن.
٣. يجب أن يتضمن أي طلب للمعلومات بناء على هذه الاتفاقية وصفا موجزا
للأسباب التي تسوغ الطلب.
المادة الحادية عشرة
يمكن لأي من الطرفين رفض أي طلب للتعاون يقدمه الطرف الآخر كليا أو
جزئيا إذا رأى أن التعاون:
١. يتعارض مع سيادته أو أمنه الوطني.
٢. يتعارض مع مصلحته العامة أو تشريعاته الوطنية.
٣. إذا كان من الممكن أن يترتب عليه إضرار بالتحقيقات والإجراءات القائمة على
إقليمه.
٤. يتعارض مع قرار محكمة تابع لإقليمه أو تنفيذ عقوبة قضائية.

المادة الثانية عشرة

يمكن لنلرفين - عند الحاجة - تشكيل لجنة خبرا، مؤقتة أو دانمة تض

مختصين في مكافحة الجريمة والتدريب المتخصص في مجال الأمن في كلا البلدين،
وتكون مهمة هذه اللجنة مناقشة أوجه التعاون في هذه الموضوعات وإعداد المقترحات
اللازمة لتطوير هذه الاتفاقية لتقديمها إلى السلطات المختصة. ويمكن لهذه
اللجنة أن تجتمع بالتناوب في كل دولة مرة في السنة، أو عند الحاجة بناء على
اتفاق الطرفين.

المادة الثالثة عشرة
جميع النفقات المترتبة عن تنفيذ هذه الاتفاقية يتحملها الطرف الذي تمت
الإجراءات على إقليمه. ويمكن للسلطات المختصة في البلدين - بناء على اتفاق
مشترك - أن تقرر عكس ذلك في كل حالة على حده.
المادة الرابعة عشرة
يسوى أي خلاف ينشأ عن تفسير أحكام هذه الاتفاقية عن طريق المفاوضات
المباشرة بين الطرفين. وإذا لم يتوصلا إلى اتفاق يسوى الخلاف عبر القنوات
الدبلوماسية.
المادة الخامسة عشرة
لا تؤثر هذه الاتفاقية على التزامات الطرفين الناشئة من الاتفاقيات
الثنائية ومتعددة الأطراف التي يكون أي منهما طرف فيها.
المادة السادسة عشرة
١. يلتزم كل طرف بعد التوقيع على هذه الاتفاقية ببدء إجراءاته اللازمة
للتصديق عليها بأسرع وقت ممكن. وتدخل هذه الاتفاقية حيز النفاذ بعد
